MOTORCYCLE RENTAL AGREEMENT
Subject and Duration of the Contract
1. The contract has been concluded for the rental and use of motorcycles owned by Kalkan Nirvana Rent a Car to the Tenant within the framework of the conditions stipulated in the contract. The contract is valid from the date of signing the contract and will terminate automatically at the end of this period without the need for any notice.
Obligations of the Tenant
(1) The Tenant undertakes not to let anyone use the Motorcycles rented within the scope of the Agreement, except himself and the persons whose names he has registered. Otherwise, the Tenant will be compensated for any loss or damage.
(2) Motorcycles, other than normal usage purposes, such as training, racing, off road, rally, etc. It cannot be used for any purpose whatsoever. Otherwise, the Tenant will be liable to cover all damages and losses that may occur for this reason.
(3) The tenant is responsible for all damages that may occur as a result of using the vehicle outside its capacity and production purpose, hitting places other than the road level such as bumps and potholes, using it in the field and on the beach, and any damage that may occur as a result of water entering the engine or other parts of the vehicle.
(4) Motorcycles cannot be overloaded or loaded. Otherwise, the Tenant will cover all damages and losses that may occur for this reason.
(5) During all periods when motorcycles are used; The safety of life and property of the person(s) on the motorcycle will be protected by taking all necessary precautions such as wearing a helmet, wearing a motorcycle jacket, using knee and waist protection, not loading the motorcycle with loads or attachments that will disrupt its balance, and avoiding drunk driving by the drivers . In addition, maximum attention will be paid to traffic rules and any behavior that may harm the life and property of third parties will be avoided. If the Renter causes damage or loss to the life or property of other persons on the motorcycle, he/she will be solely responsible for covering any damage or loss that may arise as a result. For this reason, if Kalkan Nirvana Rent a Car has to undertake any damage or make payment, Kalkan Nirvana Rent a Car will have recourse to the Tenant for compensation for the damage in question.
(6) The Tenant is obliged to cover gasoline expenses during the Lease Period. The tanks of the motorcycles will be returned in the same way as they were delivered. If there is excess gasoline left, no refund will be given.
(7) During the contract period, periodic maintenance of the motorcycles will be carried out only at the services notified by Kalkan Nirvana Rent a Car, using original parts, at the km/times specified in the maintenance booklet. If the need for towing or similar services arises, the Tenant will first inform Kalkan Nirvana Rent a Car and immediately submit all information, documents and invoices regarding this situation to Kalkan Nirvana Rent a Car. The Tenant's maintenance and repairs in any service other than those specified in the user manual will constitute the reason for the expiration of the warranty of the Motorcycles. The tenant will be solely responsible for covering all damages and losses that may occur for this reason.
(8) All traffic fines or road tolls accrued for motorcycles during the period the Agreement is in force will be paid by the Tenant within the legal periods. Even if the relevant payment documents are notified to Kalkan Nirvana Rent a Car after the Lease Agreement ends, the Tenant will be solely responsible for these payments. For this reason, if Kalkan Nirvana Rent a Car has to undertake any penalty, expense or damage arising from the Tenant's use or make any other payment, Kalkan Nirvana Rent a Car will have recourse to the Tenant for compensation for such damage.
(9) The tenant must keep the motorcycle locked whenever it is not in use.
(10) The tenant must ensure that the correct and appropriate fuel is used.
(11) The tenant must keep the tires and their air pressure at the required level.
(12) The tenant cannot sell, rent or dispose of the motorcycle or any of its parts.
(13) The Lessee cannot grant legal rights to the motorcycle to any person, cannot transfer his own rights, or rent it to third parties. The phone number you can reach 24 hours a day in case of emergency will be given to you by the office representative where you received the motorcycle.
(14) Kalkan Nirvana Rent a Car will not accept responsibility for personal belongings forgotten inside the motorcycle.
Financial Provisions
(1) The Rental Fee will be stated in each report, taking into account the motorcycles rented.
(2) If the Tenant does not return the motorcycles within 24 hours at the latest after the end of the Rental Period, he will pay one times the daily rental fee for each day of delay to Kalkan Nirvana Rent a Car as a delay penalty.
(3) Kalkan Nirvana Rent a Car will not be liable for any damages or claims, except for responsibilities outside the scope of compulsory liability insurance coverage.
(4) The tenant undertakes to pay the repair cost of damages not covered by insurance, which may occur due to usage error, and the fees for the days when we cannot rent the motorcycle due to damages not covered by insurance (Standard daily rental price will be charged).
(5) The tenant undertakes to pay for any damages that may occur due to the detention of the motorcycle by the Police forces for any reason and the fees for the days when we cannot rent the motorcycle.
(6) The tenant is responsible for any fees that may arise for delivering and receiving the motorcycle outside the city limits where our relevant office is located.
Insurance Provisions
(1) After the motorcycle is delivered to the Tenant, any losses that may arise due to any reason will be borne exclusively by the Tenant. If the damages and losses arising from the tenant's own usage errors cannot be documented or if the damages and losses are not covered by the insurance coverage for any reason, the tenant shall immediately pay all expenses that will be necessary to eliminate such damages and losses to Kalkan Nirvana Rent a Car without the need for a provision in this regard. accepts and undertakes to pay.
(2) During the Rental Period, the Tenant cannot leave the Motorcycles parked or temporarily in unsafe places such as open parking lots, roads or sidewalks. The Tenant is obliged to take maximum security measures while the Motorcycle is parked and to keep the Motorcycle in a closed and secure parking lot. Otherwise, the Lessee undertakes to pay all damages exclusively if the damages and losses that occur on the Motorcycle are excluded from the insurance coverage for any reason.
(3) If the motorcycle is involved in an accident in any way, the tenant must submit documents such as alcohol examination report, accident report, driver's license photocopy, other party's license photocopy, other party's traffic insurance policy photocopy, as of the date of the accident, in order to carry out the necessary insurance and other transactions. undertakes to give it to Kalkan Nirvana Rent a Car within seven days. Whether or not the Tenant is at fault, in case of failure to collect from the insurance company or any other damage due to delays that may arise in this regard, the uncollected amount or damage will be covered exclusively by the Tenant.
(4) The Lessee will be solely responsible for meeting any claims that may be made by third parties in cases where the motorcycle is involved in accidents that exceed the compulsory liability insurance policy coverage or fall outside the scope of the said coverage. If a lawsuit or claim is filed against Kalkan Nirvana Rent a Car by third parties that the tenant caused the accident, even if this situation has not been notified, the tenant must pay the entire notified amount to Kalkan Nirvana Rent a Car within one week at the latest from the date of notification of the court decision or payment document. He accepts and undertakes to pay Rent a Car. The tenant accepts and undertakes that if a lawsuit is filed or a claim is made against him/her for any reason and if he/she encounters any legal or criminal liability as a result, he/she will be solely responsible and will not assert any claim against Kalkan Nirvana Rent a Car.
In cases of damage that has not been recorded, damage repair is not carried out with the driver's declaration.
(5) If the accident occurred while the motorcycle was being used by one of the persons whose name is written in the contract, if the person was not under the influence of alcohol and/or drugs while using it, if it was involved in a unilateral accident or was stolen, by applying to the nearest police or gendarmerie station without changing the location of the motorcycle. Accident, theft and alcohol detection reports must be received, and the Material Damage Accident Report must be filled in as specified on the report.
If a motor vehicle is used without a driver's license, If the driver is underage, If the driver is suspected of alcohol or mental health, If one of the vehicles involved in the accident belongs to a public institution, If damage occurs to property belonging to public institutions, If only property belonging to third parties is damaged in a traffic accident, If the vehicle involved in the accident is damaged If one of the vehicles does not have traffic insurance, if the traffic accident results in death and/or bodily harm, the report must be prepared by the traffic police.
(6) In case of STOLEN, a "Theft Detection Report" must be received by the nearest police or gendarmerie station and the key and vehicle license must be delivered to Kalkan Nirvana Rent a Car.
(7) Responsibility for any damage exceeding the insurance coverage limits belongs to our users. You can get more detailed information about insurance from the office where you rented.
(8) Tire bursts, headlight and glass breaks, and spare tire theft are outside the scope of insurance. In case the insurance fund is not paid and the rented motorcycle is stolen, the tenant is responsible for paying the rental fee up to the date the motorcycle is found if the motorcycle is found within 45 days, and if the motorcycle is not found, the 0 kilometer sales price for that day. A second person other than the tenant can use the motorcycle; It is only possible if a valid ID and driver's license are recorded in the contract. Otherwise, the insurance will be deemed invalid and the renter of the motorcycle will be held responsible for all damage.
(9) All costs of any accident, damage, damage and loss for (50cc) engines that cannot be insured and insured, and all damages caused to the other party, will be covered by the tenant.
Delivery and Return
(1) The tenant will be present at the Kalkan Nirvana Rent a Car center during the delivery and return of the motorcycle to be rented by Kalkan Nirvana Rent a Car. Motorcycles will be checked and received by the Tenant and returned to Kalkan Nirvana Rent a Car at the same place at the end of the usage period. The Tenant accepts and declares that he/she has received the Motorcycle in a sound and working condition as of the delivery date specified in the minutes. The tenant is obliged to return the motorcycles to Kalkan Nirvana Rent a Car at the end of the rental period, together with all their materials, in a complete, undamaged, sound and working condition.
(2) The Rental Period will end as of the date of returning the Motorcycles to be specified in the minutes.
(3) If the Tenant requests an extension of the Rental Period, he is obliged to submit his request by notifying Kalkan Nirvana Rent a Car at least 24 hours before the end of the Rental Period. Kalkan Nirvana Rent a Car reserves the right to decide whether to extend the Agreement or not.
