BUYER / RENTER: The person whose name, surname, address and contact details are given on the reservation form.

2. Subject of the Agreement

The subject of this agreement is to set out the rights and obligations of the parties, under Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, in relation to the car rental service the BUYER has ordered electronically through the Kalkan Nirvana Rent a Car website.

3. Essential Characteristics and Price of the Service

The make and model of the rented vehicle, the rental dates, the pick-up and drop-off locations, the selected extras and insurance package, and the total price are set out in detail on the reservation summary page and in the reservation confirmation e-mail sent to the BUYER. That information forms an integral part of this agreement.

Prices include VAT. Where amounts are displayed in other currencies, their Turkish Lira equivalent is stated on the payment screen and payment is collected in Turkish Lira.

4. Payment

Payment is made online by credit/debit card at the time of reservation or, where so stated, at vehicle pick-up. Online payments are secured with 3D Secure verification. Your card details are neither recorded nor stored by us.

At vehicle pick-up a security deposit, the amount of which depends on the vehicle segment, may be blocked on your credit card as a pre-authorisation. It is released when the vehicle is returned undamaged and in accordance with the agreement.

5. Obligations of the Renter

• The renter must hold a valid driving licence that has been held for at least the minimum period required for the vehicle class.
• An ID card or passport and a driving licence must be presented at pick-up.
• The vehicle may only be driven by the driver(s) named in the agreement.
• The vehicle must be driven carefully and in compliance with traffic rules; it may not be driven under the influence of alcohol or drugs.
• At the end of the rental period the vehicle must be returned with the same fuel level and in the same general condition as at pick-up.

6. Right of Withdrawal and Cancellation

The cancellation, amendment and refund terms are set out in detail on the Cancellation and Refund Policy page, which forms an integral part of this agreement.

Under Article 15 of the Regulation on Distance Contracts, the consumer has no right of withdrawal from contracts for accommodation, transport of goods, car rental, catering or leisure activities that are to be performed on a specific date or within a specific period. The SELLER nevertheless allows refunds within the cancellation terms referred to above.

7. Settlement of Disputes

The Consumer Arbitration Committees and Consumer Courts in the BUYER's place of residence have jurisdiction over disputes arising from this agreement, within the monetary limits announced by the Turkish Ministry of Trade.

8. Entry into Force

By ticking the box at the payment step the BUYER declares that they have read and accept this agreement. The agreement enters into force when the reservation is approved.
